It seems unlikely Solid Snake will be appearing in Super Smash Bros. releasing on the Wii U and 3DS later this year.
Solid Snake appeared in Super Smash Bros. Brawl which was released for the original Wii a few years ago. This time however, Hideo Kojima hasn’t been contacted and it’s unlikely he’ll be making an appearance again.
Kojima said the following during a twitch event:
I’m not working on that game so I don’t know, but I don’t think that’s likely. I don’t know. Well if Mr. Sakurai is watching this, please use Snake.
It’s cool how Kojima still wants Snake in the game, but it’s unlikely to happen this late in development with Super Smash Bros. releasing later this year.

March 14, 2014 at 2:29 PMReleasing in May? I never knew they announced that! It would be a bummer if Snake wasn’t in it. I haven’t heard about Falco being in the new game either. Honestly, they shouldn’t have added the villager from Animal Crossing… I understand Megaman, but why the Villager? He’s pointless to me.
