Microsoft France made an announcement regarding the recently leaked Halo 3: ODST retail copy that was sold in France. For the gamers who play Halo 3: ODST earlier than they are supposed to, they will be banned from XBOX Live. It doesn’t matter if you buy the game from the stores or if a friend gives it to you.
As of now, Microsoft France has not released any information on the punishment, if any, for the stores who break the release date. As for the gamers, you will just get banned. Microsoft is on the lookout for everyone’s gamertag for early players on XBL!
I guess this will apply to North America as well. Take precautions when playing your burned copy on your modded Xbox pirates!
“Microsoft is formal, people who play Halo 3: ODST around before the release date will be banned from Xbox Live!” – Microsoft France
[UPDATE] Stephen Toulouse of XBOX Live Police : “However, if you have Halo ODST achievements and haven’t played the game, prepare for a gamerscore reset.”

August 27, 2009 at 3:26 PM“Mr. Puffnstuff! Some stores in Europe are selling ODST early!”
“But… but those stores are under strict instructions NOT to sell early!”
“I know, but people are still buying it! Our customers certainly are loyal and eager to try this next chapter in the blockbuster series…”
“Those BASTARDS. Paying money for our game! BAN THEM!”
“But Mr. Puffnstuff, what about the stores who-”
“We can’t afford to alienate a STORE, Bigglesworth, but I’ll be damned if I’m not prepared to punish the consumers who took advantage of a store’s rule-flouting!”
“Isn’t it the consumers who pay for all-”
“BAN!”

August 27, 2009 at 4:45 PMI’d like to know which website your using, most only offer release day shipping. I think its fair, because you can’t say that if someone wants to play that game VERY badly, they will lie and fight to get it. “Oh, but this store has already started selling them” or “I heard the release day was pushed forward, should’ve come out today” I’ve worked the register when we released games, and there are some who will go to as much length as to step behind the counter during a sale to grab a copy such as World of Warcraft expansions. As for the store, says it right on the shipping packages what the release day is, so there shouldn’t be any confusion. If an employee sold it before release day, fire his butt, because their are strict penalties such as large sums of money or even jail time.

September 8, 2009 at 7:02 AMMicrosoft said they will not ban ppl who play it early with legal copies of the game, this is a lie, they did say they will ban ppl with ilegal copies of the game. Only 100 copies leaked in FRANCE! so logic tells you if a dumbass in another country plays it early HE GETS BANED!
